The Prospective Marriage visa (subclass 300) lets a foreign national enter Australia to marry an Australian citizen, permanent resident, or qualifying New Zealand citizen, then apply for permanent residence. The couple must have met in person as adults and genuinely intend to marry within the visa validity period.

The visa is granted for 9 to 15 months from the date of grant and includes full work and study rights. It is not renewable, but once married, holders can apply for a Partner visa (subclass 820/801) — a direct pathway to permanent residence. The base application charge is AUD 11,710.

Requirements

PUBLISHED REQUIREMENTS

Must be aged 18 or over.

Must be sponsored by an Australian citizen, permanent resident, or qualifying New Zealand citizen aged 18 or over.

Must have met the prospective spouse face-to-face as adults since turning 18 and know each other personally.

Must genuinely intend to marry the sponsor within the visa validity period.

Must genuinely intend to live together as spouses after marriage.

Must meet health and character requirements.

Must be outside Australia at the time of application.

No legal impediment to the marriage under Australian law.

REQUIRED DOCUMENTS

Valid passport and national identity documents.

Birth certificate.

Police clearance certificates for all countries where the applicant has spent 12+ months in the last 10 years.

Evidence of relationship (e.g., photos, communication records, statements from friends/family).

Form 888 (statutory declarations from witnesses).

Letter from an authorized marriage celebrant confirming the Notice of Intended Marriage (NOIM) has been lodged.

Sponsorship form and evidence of sponsor's citizenship/residency.

Form 80 (Personal particulars for character assessment).

Form 47A (if including dependent children aged 18+).

Evidence of financial dependency for any children included.
